Please take the time to read these terms carefully before making a purchase.
Fair and Equal Treatment
The following terms apply to all customers. To ensure that we provide fair and equal treatment to all customers, exceptions will not be made for any individual / for any reason.
Please do not place our staff in a difficult situation by asking them to make exceptions.
Please do not proceed with payment or booking if you do not agree with these terms.
(Term time programs)
Parents / carers are only permitted to enter the training area during our Mini movers program. For all other programs, designated waiting areas are provided for your convenience.
Please ensure that you are certain of your booking before you make it, we are unable to offer refunds for non attendance, or change of mind. If an enrolment needs to be cancelled due to unexpected injury or illness, we may be able to offer an account credit for future programs. In this situation a medical certificate will be required.
We reserve the right to cancel any enrolment, at any time, without providing reason. In this situation, you will be refunded for any remaining classes.
Payment must be made in full at the time of booking. We are unable to hold or reserve spaces without payment.
For all booking requests received via email, text message or Facebook, we will process payment with your stored details. If you would prefer to use a different method of payment, please use our online booking system.
We are not able to offer make up sessions, credits or refunds if a student is not able to attend their enrolled timeslot.
Early bird discounts can not be used in conjunction with any other offer or credit.
Term prices advertised are a discounted rate for full term enrolments only. This price includes a student registration fee of $29. Late enrolments / partial enrolments will be charged at the rate of $25 per class + $29 registration fee. Cancelled enrollments will be calculated with the above mention formula.
We are not able to issue refunds or credits where online purchases have been made without using discount codes.
We are able to make one booking change per child, per term free of charge. Additional booking changes will incur a $10 administration fee per change, per child.
Please do not make an online booking after requesting a booking via email. This will lead to a double booking, which will incur cancellation fees.
Any refunds issued will incur a 20% administration / transaction fee to cover our costs.
All students attending our classes are required to adhere to our student code of conduct. You can view the code of conduct here.
Students in breach of the student code of conduct will be removed from any TMA programs. Any adults accompanying children to a TMA facility are expected to behave in a polite and respectful manner at all times. Any rude or threatening behaviour will result in a lifetime ban from any TMA facility. In this instance, no refunds or credits will be provided for unused classes.
These terms apply to all purchases and bookings, including but not limited to; in person, over phone, via SMS, via email, via social media and online. By proceeding with a booking you are agreeing to these terms.
What are my options for cancelling my term time booking?
Cancelling prior to the term start date - We can either provide an account credit to be used for future terms, or, transfer your booking to a friend or family member. We are not able to issue a refund.
Cancelling once the term has begun - Your child's enrollment can be transferred to a friend or family member that wishes to take their place. It is the responsibility of the purchaser to arrange this. All transfers must be finalised before the end of the second week of term. We are not able to issue a refund or account credit.
Cancelling after the second week of term - Unfortunately we are not able to offer cancellations or transfers at this point. This is because term registrations have now closed and we are unable to offer the space to another student.

(Holiday programs)
If you are making a group booking on behalf of another company (holiday care, respite care etc), please contact us prior to making your booking. We do not permit external staff to enter the training area during sessions that are open to the general public. Failure to make prior contact with us to discuss your needs may result in your booking being cancelled on the day. In this situation you will forfeit any fees paid. Tickets purchased will not be credited, refunded or reissued.
The ticket / tickets that you are purchasing are for your selected date(s) only. All sales are final. Tickets are non refundable and are only valid for the date(s) and time(s) that they are scheduled for. Limited tickets are available for each session. We are unable to exchange tickets or refund / credit tickets. Sessions may be rescheduled online via your original booking email. Sessions can not be rescheduled less than 24 hours before the session start time.
Payment must be made in full at the time of booking. All payments are final. We are unable to hold or reserve spaces without payment.
All students will need enclosed sports shoes to participate. Students that do not have suitable footwear may not be able to participate in the session. Please note that parents are not permitted to enter the training area.
We are unable to offer refunds or credits for non attendance, sickness, isolation or change of mind. All ticket sales are final as we are unable to sell your ticket on to another student.
We are not able to issue refunds or credits where online purchases have been made without entering discount codes, where discount codes have been entered incorrectly, or have not been accepted online. Please ensure that you check the final total before processing payment. We are not able to make changes or apply credits after a transaction has been finalised.
Students that are not collected within 15 minutes of the scheduled session finish time will be automatically enrolled into our late pickup service. This service is billed at $100 per hour, per child. This will be charged to your stored billing details.

Q&A
Q - My child is sick / in isolation and can not attend their scheduled session. Can I reschedule?
A - Your session can be rescheduled via your online portal upto 24 hours prior to the session start time. This must be done via your online portal that is accessed through your booking confirmation email. For multiple tickets, you will need to reschedule each ticket individually. Unfortunately we are unable to reschedule sessions once the 24 hour window has closed.
Q - My child can no longer attend their scheduled session. Can a friend take their place?
A - Yes, we are able to change the booking details so that a friend or family member can take your ticket.

+4 Weeks notice - 20% administration fee charged
Less than 4 weeks notice - 50% fee charged
less than 1 week notice - 100% fee charged
We will provide a full refund for any parties that are cancelled by us due to government mandated covid-19 restrictions.
We will comply with all government mandated vaccine requirements. It is the responsibility of the customer to ensure that they meet the specified requirements to attend any of our facilities. We are unable to offer refunds or credits in the event that a student is unable to attend or take part due to not meeting these requirements.
Please provide at least 2 weeks notice via email if you require to up-size your party. We may not be able to accommodate requests made with less than 2 weeks notice.
Liability
By purchasing a pass for or by using any of the facilities at any The Motion Academy venue, the customer and all participants agree to be bound by these terms and conditions.
IF YOU ARE MAKING A PURCHASE ON BEHALF OF ANOTHER PERSON, YOU AGREE THAT YOU ARE MAKING THE PURCHASE AND ENTERING THIS CONTRACT AS THEIR AGENT. THIS IS INCLUSIVE OF ALL PROGRAMS AVAILABLE INCLUDING GROUP EVENTS, PRIVATE FUNCTIONS AND BIRTHDAY PARTIES.
Movement and fitness training is fun, challenging and highly rewarding. But there are some risks involved so please read this before you take part in any activity or service.
The activities available at The Motion Academy may be considered dangerous Recreational Activities with Inherent Risks and Obvious Risks as defined by the Civil Liability Act 2002 (WA).
The customer acknowledges that the recreational activities available at The Motion Academy are dangerous with many inherent risks and hazards, and as a consequence personal injury and sometimes death can occur, and the customer assumes and accepts all such risks and hereby waives the right to sue The Motion Academy / TMA KIDS PTY LTD for any personal injury or death in any way whatsoever caused by or relating to the customer’s participation in such activities.
Participation in these activities is entirely at your own risk. Please ensure that you understand the following:
1. I have disclosed to the staff of The Motion Academy any history of injury, disease or weaknesses that would limit or effect my own or any participant under my cares ability to participate in physical activity and will disclose any future changes to physical and mental state that may effect continued participation.
2. I understand that any of the activities available at The Motion Academy involve risks that may cause various injuries and that such injuries may result in death or serious disability.
3. I understand that athletic activities of any type can cause harm or injury in susceptible people and that I am responsible for seeking medical advice from my own medical care provider(s) about whether participation in such activities is advisable for me or any person under my care.
4. I understand that the activities available are physically demanding and involve training at heights, which in susceptible people may cause panic, hyperventilation or heart attack.
5. I understand the specific risks involved in trampolining, which may result in injuries due to falls or collisions with the equipment.
6. I understand the specific risks of all activities available at The Motion Academy. I wish to participate / I wish all children under my care to participate and do so entirely at my / their own risk of injury or bodily harm.
7. I understand that photos and video may be taken of me or my children during participation in activities at The Motion Academy, which may be used for online marketing / promotional content and this liability waiver assumes consent.
8. The customer agrees to pay the cost of and authorises The Motion Academy to take all steps it considers reasonably necessary to protect the customers welfare in the event of personal injury. This includes the administration of any emergency medical treatment and ambulance transportation.
9. If purchasing passes for children that are not my own, I have obtained consent from the parents / legal guardians of all persons under 18 years of age to electronically sign this document on their behalf.
10. Any person using the facility for self directed training, such as open sessions, jams or private hire, is entirely responsible for assessing the suitability of any and all equipment for their desired use. The company takes no responsibility for any injury or harm that may arise from improper use of equipment.
I hereby indemnify, release and hold harmless The Motion Academy Pty Ltd, TMA Kids Pty Ltd, the owner of the premises of The Motion Academy and all directors, employees, staff and assistants of The Motion Academy or any other persons involved in my participation in activities at The Motion Academy from any suit, demand, action or claim for compensation whether for personal injury or damage to property arising from my own or any child under my cares participation in any activity at The Motion Academy.
I am aware that this waiver is ongoing and will apply to all future occasions in any activity at The Motion Academy. I furthermore acknowledge that this document is contractual and may be relied upon in any proceedings commenced by me, my heirs, associates, executors and assigns.
